Terms and Conditions of Sale

1. Legal Notice

These terms and conditions of sale (hereinafter referred to as “T&Cs”) govern all contractual relationships between Ibiazavola Vincent Andrianoasy, Sole Proprietor (EI), whose registered office is located at 14, chemin de la Chasse, 31770 Colomiers, registered in the Trade and Companies Register (RCS) of Toulouse under number 980 133 029 R.C.S. Toulouse (hereinafter referred to as “the Publisher”), and any natural or legal person (hereinafter referred to as “the Customer”) wishing to access the paid services of the mobile application AscendAI (hereinafter referred to as “the Application”).

2. Purpose

These T&Cs aim to define the terms and conditions of sale of the services offered by the Application, as well as the rights and obligations of the parties in this context.

3. Services Offered

The Application offers paid premium features, including:

  • Progress tracking

  • Mood analysis

  • Personalized advice

  • AI support (via Mistral AI) for Elite subscribers

4. Subscriptions

The Application offers two subscription levels:

  • Master: Access to all premium features except AI support.

  • Elite: Full access to all premium features, including AI support.


Subscriptions are offered as recurring monthly or annual payments.

5. Essential Characteristics of the Services

The services offered by the Application include personal progress tracking in the form of a journal, mood analysis, personalized assistance and advice based on user-entered data, powered by AI for Elite subscribers.

6. Prices

Subscription prices are indicated in euros (€) including all taxes (TTC) and may vary depending on promotional offers and price updates. Current prices are available on the Application.

7. Fees, Delivery Date, and Methods

Digital services are delivered immediately after payment confirmation. There are no delivery fees for digital services.

8. Contract Execution Terms

The subscription is active upon payment confirmation and remains valid for the chosen duration (monthly or annual). Renewal is automatic unless canceled by the Customer before the renewal date.

9. Payment Terms

Subscription payments are made through Apple’s payment platform (App Store). Accepted payment methods include credit/debit cards accepted by Apple. In case of payment delay, access to premium services may be suspended until payment is regularized.

10. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the Customer acknowledges and agrees that the right of withdrawal cannot be exercised for digital services provided immediately after purchase and accessible upon payment.

11. Legal Warranty of Conformity and Hidden Defects

The Publisher guarantees the conformity of the services offered and the absence of hidden defects, in accordance with Articles L217-4 and following of the French Consumer Code and Articles 1641 and following of the French Civil Code. In case of non-conformity or hidden defects, the Customer can contact the Publisher for repair or replacement.

12. Commercial Warranty and After-Sales Service

No additional commercial warranty is offered. After-sales support is available via the email address hello@simplyibi.io. Communication costs for contacting after-sales service are borne by the Customer.

13. Contract Duration and Termination Conditions

Subscriptions are concluded for a determined duration (monthly or annual) and are automatically renewable. The Customer can cancel their subscription at any time via their Apple account settings, with the cancellation taking effect at the end of the current subscription period.

14. Security Deposit or Guarantee

No security deposit or guarantee is required from the Customer.

15. Minimum Contractual Obligations Duration

The minimum duration of contractual obligations corresponds to the duration of the subscribed subscription (monthly or annual).

16. Existence of a Code of Conduct

There is no specific code of conduct applicable to these T&Cs.

17. Dispute Resolution Terms

In case of a dispute, the parties will attempt to find an amicable solution. If not, the Customer can resort to a consumer mediator. These T&Cs are governed by French law. In case of a dispute and in the absence of an amicable solution, French courts will have exclusive jurisdiction.
